Terms of Service
1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and PuckWeekly Inc. ("PuckWeekly," "we," "us"), a corporation incorporated under the Canada Business Corporations Act and registered extra-provincially in Manitoba, with its registered office at 1800–One Lombard Place, Winnipeg, Manitoba R3B 2A3, Canada.
They govern your use of puckweekly.ca (and puckweekly.com, which redirects to it), the PuckWeekly web and mobile applications, and any related services (together, the "Service").
By creating an account, joining a League, or using the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.
We also publish a Privacy Policy, which is incorporated into these Terms by reference.
2. Definitions
- “Manager” means any person with a PuckWeekly account who participates in a League;
- “Commissioner” means the Manager who creates a League, invites others, configures scoring, and buys the Season for the League;
- “League” means a private group consisting of four (4) to twelve (12) Managers competing over a Season;
- “Season” means a fixed-length competition with a published start and end date, currently six (6) weeks, sold as a one-time purchase;
- “Week” means a scoring period running Monday through Sunday, with a draft window on the preceding weekend;
- “Draft Session” means the live snake draft that assigns each Manager a six-player roster for a week;
- “Placement Points” means points awarded across a Season for weekly finish (1st = 3, 2nd = 2, 3rd = 1, 4th and below = 0; ties split);
- “Content” means anything you submit to the Service, including League names, team names, and profile information.
3. Eligibility
You must be at least the age of majority in your province or territory of residence to use the Service as a Manager, as a Commissioner, or to buy a Season. The Service is not intended for anyone under the age of majority, and we do not knowingly permit accounts for people under the age of majority.
By creating an account you confirm that you have reached the age of majority in your province or territory of residence. If we learn that an account belongs to someone under the age of majority, we will close it.
Where the Service is offered. The Service is currently offered only in Canada, excluding the Province of Quebec. You must be a resident of a Canadian province or territory other than Quebec to create an account, to be a Manager, or to be a Commissioner.
We do not offer the Service in Quebec, in the United States, or anywhere else at this time, and we do not represent that it is appropriate or lawful to use elsewhere. We may refuse or close accounts that appear to originate outside the territory we serve. This is a limit on where we currently operate, not a judgment about anyone. We expect to expand.
You may not use the Service if we have previously terminated your account.
4. Your account
Accounts are created with an email address and password, or through Google Sign-In. You agree to provide accurate information and keep it current.
You are responsible for everything that happens under your account. Keep your credentials secure. We recommend enabling multi-factor authentication. Tell us immediately at security@puckweekly.ca if you suspect unauthorized access.
One account per person. Creating or controlling more than one account, or letting another person use your account, is grounds for suspension and forfeiture of any standings.
The Service is invite-only. You need a valid invite code to join a League. Invite codes are personal. Do not share, sell, or publish them.
5. How the game works
Managers snake-draft a fresh six-player roster each weekend: three forwards (F1, F2, F3), two defense (D1, D2), one goaltender (G). No cross-position filling. Fantasy points accumulate from real NHL game statistics Monday through Sunday. Weekly finish determines Placement Points. Once the week's final games are recorded, scores lock and everything resets.
A few rules about how the Service treats that game:
Draft state is server-side and final. Pick timers, pick order, player availability, and auto-draft selections are determined by our servers. Where the app on your device disagrees with our servers, our servers govern.
Auto-draft. If your pick timer expires, the Service will automatically select the best available eligible player by our estimate of fantasy points for the week. Auto-drafted picks are final. You are responsible for being present or accepting the auto-draft outcome.
Statistics. Fantasy scoring is derived from third-party NHL data. That data can be delayed, revised, or wrong. We may recalculate scores and standings to correct errors. Corrections may change past results, including weekly winners and Placement Points.
Commissioner authority. Commissioners buy the Season, configure scoring settings, invite and remove Managers, and make certain League-level decisions. Commissioners act on their own behalf, not ours. We are not responsible for a Commissioner's decisions, and we generally will not intervene in disputes inside a League. Scoring settings lock after a League's first draft.
Changes to the format. We may change game rules, scoring defaults, roster structure, timers, and League limits. Material changes will be announced before they take effect where reasonably practical.
6. No wagering, no cash prizes
PuckWeekly is a game of skill played for standings and bragging rights.
We do not accept wagers. We do not hold entry fees in a prize pool. We do not award cash, cryptocurrency, or prizes of monetary value. The price of a Season is a fee paid by one person for access to software. It is not an entry fee, it is not pooled, and no part of it is distributed to any Manager.
You may not use the Service to organize, facilitate, or settle wagering between Managers, side bets, or any pay-to-play pool. Doing so is a breach of these Terms and may violate the law where you live. If we become aware of it, we may terminate the League and the accounts involved without refund.
You are solely responsible for any arrangement you make outside the Service. We are not a party to it.
7. Fair play
You agree not to:
- Create or use multiple accounts, or play in a single League under more than one identity
- Collude with other Managers to affect draft order, roster outcomes, or standings
- Trade, sell, or transfer accounts, rosters, Leagues, or invite codes
- Use bots, scripts, or automation to draft, monitor, or interact with the Service
- Scrape, crawl, or bulk-extract data from the Service, or use it to build a competing product
- Reverse engineer, decompile, or attempt to access source code or non-public APIs
- Interfere with Draft Sessions, websockets, timers, or scoring, including by exploiting bugs
- Probe, scan, or test the security of the Service without our written permission
- Upload Content that is unlawful, hateful, harassing, obscene, or that impersonates another person
- Use the Service to send unsolicited messages or to harvest other Managers' personal information
If you discover a bug that gives you an advantage, report it to support@puckweekly.ca. Exploiting it instead is a breach of these Terms.
8. Buying a Season
What you're buying. A PuckWeekly Season is a fixed-length competition, currently six (6) Weeks, with a published start and end date. Each Season is sold separately as a one-time purchase. Buying one Season does not enrol you in the next.
Who pays. The Commissioner buys the Season for the League. Managers do not pay.
Price. $25 CAD per League, per Season, in Canadian dollars. The price for each Season is shown at checkout before you pay.
No automatic renewal. We do not store your card for future charges and we will never bill you automatically. When a Season ends, you choose whether to buy the next one. There is nothing to cancel.
Taxes. Prices are shown exclusive of tax. Applicable taxes are calculated and added at checkout based on the Commissioner's province or territory. This includes federal GST/HST, and provincial sales tax where we are required to collect it, including Manitoba retail sales tax (RST). You are responsible for any tax we are not required to collect but that you owe on the purchase.
Processing. Payments are processed by Stripe. We don't store your full card details. Your use of Stripe is subject to Stripe's own terms.
Access. Access begins when payment clears and ends when the Season ends. If payment doesn't clear, the League cannot draft.
Refunds. We will refund a Season in full if you ask before your League's first draft of that Season. Once the first draft has started, the Season is non-refundable. We do not refund unused Weeks, Seasons affected by NHL work stoppages or schedule changes, or Leagues that stop playing partway through. To request a refund, email support@puckweekly.ca.
Founding rate. Where we offer a founding rate, it applies to the Season it is advertised for. We will say plainly if it applies to later Seasons.
Price changes. Each Season is priced independently. A change in price affects Seasons you have not yet bought, never one you have already paid for.
Before you pay. We disclose our legal and business name, contact information, a description of the Season you are buying including its start and end dates, the total price including taxes, the currency, and our refund policy, all before you complete the purchase. You get an express opportunity to review, correct, accept, or decline. We email a copy of the agreement to the Commissioner within 15 days. Manitoba consumers have cancellation rights under The Consumer Protection Act (Manitoba) and the Internet Agreements Regulation where these requirements are not met; consumers elsewhere in Canada have comparable statutory rights.
9. Season formats and scheduling
We publish each Season's start date, end date, and length before it opens for purchase. Seasons may be themed and may run consecutively, but each is a separate product.
We may change the length, timing, or availability of future Seasons. Doing so never affects a Season you have already bought.
If we cancel a Season we have already sold before its first draft, we refund it in full.
10. NHL data and third-party rights
PuckWeekly is an independent product. We are not affiliated with, endorsed by, or sponsored by the National Hockey League, the NHL Players' Association, any NHL club, or any player.
NHL, the NHL Shield, team names, team logos, and player names and likenesses are the property of their respective owners. They appear on the Service to identify real athletes and teams for the purpose of a statistics-based fantasy game.
Player statistics are sourced from MySportsFeeds, an independent data provider that is not affiliated with the NHL, and are subject to that provider's terms. We do not guarantee their accuracy, completeness, or timeliness.
The Service depends on third parties including Stripe, Google, Hetzner (hosting), Cloudflare (network security, content delivery, and web hosting), Resend (email), Sentry (error monitoring), and MySportsFeeds (statistics). We are not responsible for their outages or acts.
11. Intellectual property
PuckWeekly™, the PuckWeekly logo, the puck mark, and the design, code, text, and layout of the Service are owned by PuckWeekly Inc. and protected by copyright and trademark law. A trademark application has been filed with the Canadian Intellectual Property Office.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. That is the whole licence. Nothing else is granted.
You keep ownership of your Content. By submitting it, you grant us a worldwide, royalty-free licence to host, display, reproduce, and distribute it as needed to operate and promote the Service, and sublicense to our service providers as needed to operate the Service. You confirm you have the right to grant that licence.
We may remove Content that breaches these Terms, including League and team names that are unlawful, hateful, obscene, or that infringe someone else's trademark.
If you send us feedback or suggestions, we may use them freely without obligation to you.
12. Availability
We aim to keep the Service running, especially during draft windows. We do not promise uninterrupted or error-free operation.
The Service may be unavailable for maintenance, updates, or reasons outside our control. A Draft Session may be interrupted, delayed, or affected by outages or data errors. Where a draft is materially disrupted, we may, at our discretion, resume it, restart it, void it, or complete it by auto-draft. We are not liable for the outcome of a disrupted draft, an auto-drafted roster, or a scoring correction.
The Service depends on the NHL playing games. Lockouts, cancelled games, and schedule changes are outside our control and do not entitle you to a refund once a Season's first draft has started.
13. Suspension and termination
You may delete your account at any time from your settings.
We may suspend or terminate your account or a League, with or without notice, if you breach these Terms, if we suspect fraud or abuse, if required by law, or if we discontinue the Service.
If we terminate a League without cause during a paid Season, we will refund that Season on a pro-rata basis. If we terminate for breach, no refund is owed.
Sections 6, 7, 10, 11, 14, 15, 16, 18, and 19 survive termination.
14. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about accuracy of statistics, scores, standings, or draft outcomes.
We do not warrant that the Service will meet your requirements, that it will be secure or error-free, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties. Where that's the case, the exclusions above apply only to the extent permitted.
15. Limitation of liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or loss of goodwill, including anything arising from a missed pick, an auto-drafted roster, a scoring error, a draft outage, or a lost standings position.
Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you actually paid us in the twelve months before the claim arose, or CAD $50.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
16. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, liability, and reasonable legal cost arising from your use of the Service, your Content, your breach of these Terms, or your violation of anyone else's rights, including any wagering or side arrangement you make with other Managers.
17. Changes to these Terms
We may update these Terms. We will post the updated version with a new effective date, and for material changes we will notify you by email or in the Service at least 30 days before they take effect.
Continued use after the effective date means you accept the updated Terms. If you don't accept them, stop using the Service. Where a change materially disadvantages you during a Season you have already paid for, and you tell us within 30 days, we will refund that Season on a pro-rata basis.
18. Governing law and disputes
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable in Manitoba, without regard to conflict-of-law rules.
You agree to first contact us at legal@puckweekly.ca and attempt to resolve any dispute informally for at least 30 days before starting a formal proceeding.
If that fails, the courts of Manitoba have exclusive jurisdiction, and you consent to venue there.
Nothing in this section deprives you of a right you cannot waive. If your province's consumer protection law gives you the right to bring proceedings locally, or restricts choice of law or forum, that right prevails. Manitoba consumers retain their rights under The Consumer Protection Act (Manitoba), including the internet agreement provisions described in Section 8.
19. General
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us regarding the Service.
Severability. If a provision is unenforceable, the rest stays in force.
No waiver. Not enforcing a provision doesn't waive it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Language. These Terms are provided in English. The Service is not currently offered in Quebec, and we do not offer a French-language version of these Terms or of the Service at this time.
